General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions apply to all orders placed by consumers and entrepreneurs through the online shop Powerzk.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

An entrepreneur is a natural or legal person or a legal partnership that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.

2. Conclusion of Contract

The presentation of products in the online shop does not generally constitute a legally binding offer, but rather an invitation to place an order.

The customer can select the desired products and place them in the shopping cart. Before completing the order, the entered data can be reviewed and corrected if necessary.

By pressing the button to complete the order with payment, the customer submits a binding offer to conclude a purchase contract for the goods contained in the shopping cart.

Upon receipt of the order, the customer will generally receive an electronic confirmation.

The purchase contract is concluded as soon as we accept the order. Acceptance can occur, in particular, through an explicit order confirmation, the dispatch of the goods, or a corresponding notification.

The contract language available for the conclusion of the contract is German.

4. Prices

All prices indicated in the online shop are in Euro (EUR) and include the statutory value-added tax, if applicable.

Additional shipping costs incurred will be displayed to the customer before the order is completed.

The prices valid at the time of the order in the online shop apply.

5. Payment Terms

The available payment methods will be displayed to the customer during the ordering process or checkout.

Payment is due according to the terms of the selected payment method.

Payment processing may be carried out via external payment service providers. In addition, the business and data protection conditions of the respective payment service provider may apply.

6. Delivery and Shipping

Delivery will be made to the delivery address provided by the customer during the ordering process.

The available shipping methods, shipping costs, and estimated delivery times are specified in the online shop or during the ordering process.

The customer is obliged to provide a complete and correct delivery address when ordering.

Should a delivery not be possible due to an incorrectly provided address by the customer, additional costs incurred as a result may be charged to the customer to the extent legally permissible.

7. Product Availability

Should a ordered item be exceptionally unavailable, we will inform the customer thereof.

If delivery is permanently impossible, we reserve the right not to accept the order regarding the affected product or to withdraw from the contract in accordance with legal provisions.

Payments already made for undelivered goods will be refunded in this case.

8. Retention of Title

The delivered goods remain our property until full payment of the purchase price.

9. Right of Withdrawal

Consumers generally have a statutory right of withdrawal.

The details regarding the conditions, deadlines, and consequences of withdrawal can be found in our separate Cancellation Policy, which is available in the online shop.

10. Returns

In the event of an effective withdrawal, the statutory provisions as well as the information in our cancellation policy apply with regard to returns and refunds.

The customer is requested to return goods, if possible, securely and appropriately packaged.

However, this request is not a prerequisite for the effective exercise of the statutory right of withdrawal.

11. Warranty

The statutory liability for defects applies to the goods offered by us.

Should a product be defective upon delivery, the customer is entitled to the statutory warranty rights.

12. Transport Damage

If goods are delivered with obvious transport damage, we ask the customer to report such damage immediately to the deliverer if possible and to inform us as soon as possible.

Failure to comply with this request has no effect on the consumer's statutory warranty rights.

13. Product Representation

We strive for the most accurate representation of the offered products.

Depending on the screen, device, or individual display settings used, colors and representations may differ slightly from the actual product.

The respective product description and the characteristics of the actually delivered goods are decisive.

14. Vouchers and Discount Promotions

Insofar as Powerzk offers vouchers, discount codes, or special promotions, the respective stated conditions apply.

Unless otherwise stated, multiple discount promotions cannot be combined.

There is generally no claim for subsequent application of a discount code not used during the order, as far as legally permissible.

15. Liability

We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.

In the event of slight negligence in the breach of essential contractual obligations, our liability is limited to the foreseeable, typical damage within the legally permissible scope.

Mandatory statutory liability provisions, in particular according to the Product Liability Act, remain unaffected.

17. Online Dispute Resolution and Consumer Arbitration

For the out-of-court settlement of consumer disputes, the respective applicable statutory provisions apply.

Insofar as there is a statutory information obligation regarding participation in a dispute resolution procedure before a consumer arbitration board, the corresponding information will be provided in the online shop.

18. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only to the extent that it does not deprive the consumer of mandatory consumer protection provisions of the state in which the consumer has their habitual residence.

19. Place of Jurisdiction

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is determined by the statutory provisions or, if legally permissible, the provider's registered office can be agreed as the place of jurisdiction.

For consumers, the statutory rules on jurisdiction apply.

20. Final Provisions

Should individual provisions of these GTC be or become wholly or partially invalid, the statutory regulations and the validity of the remaining provisions generally remain unaffected.
